Mother Acquitted for Slapping 12-year-old Daughter Sending Explicit Photos to a 19-year-old Boy

A mother discovers that her 12-year-old daughter is sending explicit photos to a 19-year-old boy and slaps her, but the court acquits her. It is a verdict that is causing controversy from the Rome court. Especially because the young girl suffered evident injuries and bruises.

The beating

The incident dates back to 2016. According to Il Corriere della Sera, at the time of the events the defendant's daughter was just 12 years old. One day the mother discovers that the young girl is sending explicit photos to an older boy (19 years old). Real erotic images. The woman reacts and hits her daughter, causing her a bruise to the eye and a cut lip.

The educational purpose

The 42-year-old B.C. is sentenced to one year and seven months for abuse. But for the beatings due to the discovery of the sending of explicit photos on Instagram, she is acquitted. According to the judges of the Rome court, in fact, those slaps would have been given with the aim of educating the girl. The mother, therefore, would have acted in the exercise of a right or in the fulfillment of a duty.

The motivations

"Once the daughter was caught - as can be read in the reasons of the first collegiate section of the forum -, the lady undoubtedly considered to exercise that power/duty of education and correction of the children that must be recognized in each parent". The same daughter, now of age, was heard in court, and recognized that that day the mother acted to protect her. "Maybe seeing a daughter go wrong in those conditions... I don't know, I would put myself in her shoes too", she declared.

The tense relationships

In the trial phase, the woman reported that in 2016 she was going through a difficult time. Mother of three children, with her husband who had left home and forced to live with her mother, the relationship with her daughter was tense. And the discovery of those photos had triggered the furious reaction. For the judges, in any case, "the episode is legally irrelevant, also because there is no complaint for injuries or beatings". And then again: "The slaps were the triggering element of the aggressive, violent and bullying behavior that characterized the cohabitation between the mother, the daughter and the maternal grandmother", can be read in the motivations.
